1. Acceptance
By connecting your TikTok account to Exzel Publicador or using it in any other way, you accept these terms and the Exzel Publicador Privacy Policy (https://www.exzelconsulting.com/publicador/privacidad). If you do not accept them, do not connect your account.
2. The service
Exzel Publicador lets the clients of Exzel's content service review the short videos Exzel's content team has prepared for them and publish them to their own TikTok account through TikTok's official APIs (Login Kit and Content Posting API). For each video, the client can:
- post it directly to their TikTok account;
- schedule it for a date and time (Colombia time), from five minutes to sixty days ahead;
- send it as a draft to their TikTok inbox, to finish and post it in the TikTok app;
- or discard it.
The content service itself (what videos are produced, how often, deliverables and fees) is governed by the separate written agreement between Exzel and each client. Exzel Publicador does not change that agreement.
3. Eligibility and access
Exzel Publicador is available to clients of Exzel's content service through a personal invitation link. The link can be used once and expires after seven days. To use the service you must:
- be at least 18 years old and able to enter into a binding agreement, or act on behalf of an organization that authorized you to do so;
- own the TikTok account you connect, or be expressly authorized by its owner to manage it;
- keep your TikTok account in good standing and comply with TikTok's terms.
Each client connects one TikTok account, and a TikTok account can be connected to only one client. After disconnecting, reconnecting requires a new invitation from Exzel.
4. Your TikTok account and the permissions you grant
You sign in on TikTok's own login page; Exzel Publicador never sees or stores your TikTok password. When you connect, TikTok asks you to grant three permissions: user.info.basic (to show your name and profile picture), video.publish (to post the videos you confirm) and video.upload (to send a video to your TikTok inbox as a draft when you choose to). Exzel Publicador uses them only to carry out the actions you confirm.
5. Your confirmation is required for every post
Nothing is posted to your account without your explicit confirmation, given while signed in with that account. Exzel's team can prepare and suggest videos, captions and dates, but cannot confirm or post them for you. For every video, before confirming, you see the preview and choose:
- the caption, which you can edit;
- who can view the video, among the options TikTok offers your account (no option is preselected);
- whether others can comment, duet or stitch (off by default, and unavailable if your account has them turned off);
- whether the video is commercial content (“Your brand” or “Branded content”);
- the AI-generated content label (see section 7);
- and you agree to TikTok's Music Usage Confirmation and, for branded content, TikTok's Branded Content Policy.
The service posts exactly what you confirmed. For scheduled posts, just before posting it checks your account's current options with TikTok; if what you confirmed is no longer allowed, or your account cannot post at that moment, it stops and shows you why instead of posting something different. You can cancel a scheduled post before its time.
6. Your content and your responsibilities
Although Exzel's team prepares the videos, you decide what is published on your account and you are responsible for it. Before confirming a post you agree to review it and to make sure that it:
- is accurate and appropriate for your profession, including the rules on health-related information, advertising and professional ethics that apply to you;
- complies with TikTok's Terms of Service, Community Guidelines, Music Terms and Branded Content Policy;
- does not include patients' personal or health information, or any third party's personal data, without a valid legal basis;
- does not infringe anyone's intellectual property, image or privacy rights.
If something in a video or caption should change, do not confirm it: you can edit the caption yourself, discard the video, or ask Exzel's team for a new version. You must disclose commercial content truthfully.
7. AI-generated content
Some videos are produced with artificial intelligence tools, for example a synthetic voice created with the client's consent, or generated images. When Exzel's team marks a video as made with AI, it is posted with TikTok's AI-generated content label and the label cannot be removed in Exzel Publicador. You can also add the label to any other video. You agree not to present AI-generated content as if it were not.
8. Acceptable use
You agree not to:
- use the service to post to accounts you do not own or are not authorized to manage;
- post unlawful, misleading, harmful or infringing content;
- try to access other clients' videos or data, or the administration areas of the service;
- interfere with the service, circumvent TikTok's limits, or access the service by automated means.
9. TikTok and other third parties
Exzel Publicador depends on TikTok's APIs, rules and decisions. TikTok may limit how much an account can post, restrict an account, change or withdraw features, reject a video, or take time to process it. Exzel is not responsible for TikTok's decisions, availability or processing. Your use of TikTok is governed by TikTok's own terms and privacy policy. Exzel Publicador is an independent tool and is not affiliated with, sponsored or endorsed by TikTok.
10. Availability and no warranty
The service is provided “as is” and “as available”. It may be interrupted for maintenance or by failures, and a scheduled post may be delayed or fail (for example, because of a TikTok error). Exzel Publicador shows the status of each video so you can check it. Exzel does not guarantee any reach, views, followers or other results from the content you post.
11. Disconnection, suspension and termination
You can stop using the service at any time. Using “Disconnect TikTok” in the app revokes Exzel Publicador's access on TikTok, deletes your access credentials from our server and returns any scheduled posts to “To review”, so nothing else is posted. You can also remove the app's access from your TikTok settings (see the Privacy Policy).
Exzel may suspend or end your access if the content service agreement ends, if these terms are breached, or if TikTok or the law requires it. Videos already posted stay on your TikTok account; you manage or delete them in TikTok.
12. Intellectual property
The Exzel Publicador software, name and design belong to Exzel Consulting. Rights over the videos Exzel prepares for you are governed by your content service agreement. You authorize Exzel to store your videos and send them to TikTok as needed to carry out the posts you confirm.
13. Limitation of liability
To the fullest extent permitted by law, Exzel Consulting is not liable for indirect, incidental, consequential or special damages, or for lost profits or audience, arising from the use of Exzel Publicador or from TikTok's actions. Nothing in these terms limits liability that cannot be limited under applicable law.
14. Changes to these terms
We may update these terms. The date at the top of this page shows the current version. If a change materially affects how your account is used, we will tell connected clients before it applies.
15. Governing law
These terms are governed by the laws of the Republic of Colombia. Any dispute will be submitted to the competent courts of Medellín, Colombia, without prejudice to any rights you have under mandatory law.
